Actually unblocked by Trump, as DOJ appeals ruling

We won our lawsuit on May 23, with a federal judge ruling that Trump blocking me and seven others violates the First Amendment. Now, as of June 4, I am actually unblocked by the president’s @realdonaldtrump account, as are the other plaintiffs. At the same time, the Department of Justice filed a notice of their intent to appeal the ruling to the United States Court of Appeals for the Second Circuit.

Meanwhile, an unknown number of other people remain blocked by the president. The Knight First Amendment Institute, which is representing us, has asked other people who are blocked to contact them at: info@knightcolumbia.org. I would love this case to end up extending to others blocked by Trump, and other public officials.

  1. There’s a discussion of this on Slate’s Trumpcast where the lawyer explains that he disagrees, and believes that you should have lost the suit since (essentially) Twitter is a private platform and can do what it wants (notable since Trumpcast is hardly a pro-Trump space). As I understand it, your lawyers’ claim is that because of the way Trump uses Twitter, it has become, essentially, a government-affiliated public space?

    • Thanks for the tip, I’ll look for it.

No, that’s not right. We aren’t saying Twitter is a public forum. Only Trump’s threads are a “designated public forum,” because he made them so, which doesn’t have to do with whether Twitter is private or not. It’s not about what Twitter can do, but what Trump can do. (Also, note it’s no longer our lawyers’ claims, it’s the federal judge’s interpretation of the law!)
